Release of personal and/or health information to law enforcement agencies

Commercial Passenger Vehicles Victoria (CPVV) is bound by the Privacy and Data Protection Act 2014 (Vic) (Act) and the Health Records Act 2001 (Vic) in how it manages personal and health information. The CPVV is committed to protecting the personal and health information of persons with whom  it interacts within the course of the performance of its regulatory functions and activities.

The CPVV is required to comply with the Information Privacy Principles (IPPs) set out under the Act and applies strict guidelines to the release of personal information to organisations outside of the CPVV, including law enforcement agencies.

Under IPP 2.1(g), CPVV can use or disclose personal information if it reasonably believes that the use or disclosure is reasonably necessary for any of five specified purposes undertaken by or on behalf of a law enforcement agency, being:

  1. the prevention, detection, investigation, prosecution or punishment of criminal offences or breaches of a law imposing a penalty or sanction;
  2. the enforcement of laws relating to the confiscation of the proceeds of crime;
  3. the protection of public revenue;
  4. the prevention, detection, investigation or remedying or seriously improper conduct; or
  5. the preparation for, or conduct of, proceedings before any court or tribunal, or implementation of the orders of a court or tribunal.

What is a 'law enforcement agency'?

IPP 2.1(g) authorises disclosure of personal information to law enforcement agencies. "Law enforcement agency" is defined in section 3 of the Act and specifically includes state and federal police; crime commissions and examiners; the Business Licensing Authority, and the Special Investigations Monitor.

The definition also includes agencies which are involved in the prevention and detection of crime; the release of persons from custody; the execution of warrants; the provision of correctional services; the management and seizure of property under confiscation laws; and the protection of public revenue.

IPP 2.1(g) also authorises disclosure to persons who carry out any of the five functions on behalf of the law enforcement agency (for example, lawyers preparing matters for trial on behalf of a law enforcement agency or the Office of Public Prosecutions).

Making a request for personal information

In order for CPVV to comply with its obligations under the Act, if you wish to make a request for any personal/health information or documents held by the CPVV (in physical and/or electronic form), and your request is on behalf of a law enforcement agency, and is not pursuant to a court process, then the CPVV requires you to complete and submit the Request  for Personal/Health Information Form below to the CPVV's Privacy Unit via email at: privacy@cpv.vic.gov.au
