Internal review of a decision

Commercial Passenger Vehicles Victoria (CPVV) conducts internal reviews of certain decisions affecting applicants or holders of driver accreditation, commercial passenger vehicle registration or booking service provider registration.

If you wish to request a review of an infringement notice, please follow the instructions on the back of the notice itself.

You can apply for internal review of a decision where we have:

  • refused to issue driver accreditation
  • taken disciplinary action
  • disqualified a person from applying for driver accreditation
  • served an improvement notice or prohibition notice
  • imposed a condition on a commercial passenger vehicle registration, booking service provider registration or driver accreditation
  • imposed a condition on the surrender of a commercial passenger vehicle registration, booking service provider registration or driver accreditation
  • varied or revoked a condition or imposed a new condition on a driver accreditation, vehicle registration or booking service provider registration
  • issued a written direction
  • declared that a seized thing is forfeited.

You cannot apply for internal review of a decision that:

  • has already been internally reviewed by us, or
  • was made by us and not by a CPVV delegate

Eligibility

Not everyone can make an application for an internal review. Our decision letter will tell you if you are eligible to apply.

In general, you are eligible to apply for an internal review if you are:

  • an applicant for driver accreditation or commercial passenger vehicle registration
  • an accredited driver, a person in whose name a motor vehicle is registered or a registered booking service provider
  • a relevant person in relation to either of the above.

How to apply for an internal review

To apply for an internal review of a decision made by us, you must complete and lodge the following application form:

Your application for internal review must be made within 20 business days after receiving the original decision.

You can lodge this form by email to internalreview@cpv.vic.gov.au.

There is no fee for applying for an internal review. If you decide to submit any additional documents (such as medical reports) or seek legal representation, you must do so at your own expense.

What happens after you apply for internal review

Once we receive your valid application for internal review, you will receive a decision within 20 business days.  You will be contacted if any further information is required.

After an internal review has been conducted, CPVV may do one of the following:

  • Affirm the original decision
  • Vary the original decision, or
  • Set aside the original decision and substitute it with another decision.

If you do not agree with the internal review decision, information regarding your review rights will be provided to you in the decision notice.
