CPVV User Portal - terms and conditions of use

Agreement

By registering an account on the CPVV User Portal, you agree to be bound by these terms and conditions as updated from time to time.

Services available through the CPVV User Portal may be subject to additional terms and conditions, disclaimers or notices displayed on the CPVV User Portal or the CPVV website from time to time. By accessing or using any service on the CPVV User Portal, you will be deemed to have accepted and agree to be bound by any additional terms and conditions, disclaimers or notices which apply to that service.

Account information

By using the CPVV User Portal you agree to:

  • maintain the confidentiality of any account information including your username and password that you use to access any page or feature on the CPVV User Portal;
  • not disclose your username and password to, or share it, with others;
  • promptly log off from your account and any protected areas of the CPVV User Portal; and
  • promptly report any suspicious or unauthorised conduct concerning your account, username, or password to CPVV where you become aware of it and change your username and password details if your account has been compromised.

Acting on behalf of an entity

In accessing and using the CPVV User Portal, you warrant:

  • you have the authority of any entity you represent to use the CPVV User Portal on its behalf and to legally bind that entity to these terms and conditions. You must inform any entity you represent of these terms and conditions and its responsibilities under these terms and conditions; and
  • you and any entity you represent will comply with all directions and requirements of CPVV in relation to any transactions you perform using the CPVV User Portal.

CPVV User Portal security

While CPVV will endeavour to take all reasonable precautions to ensure that the CPVV User Portal is secure and virus free, no data transmission over the Internet can be guaranteed as totally secure. CPVV therefore does not accept liability (to the extent permitted by law) for:

  • the security, authenticity, integrity or confidentiality of any transactions and other communications made through the CPVV User Portal; and/or
  • any virus-related damage or loss resulting from your use of the CPVV User Portal.

Provision of information

You warrant that all information provided by you in your CPVV User Portal registration or otherwise in connection with your use of the CPVV User Portal is complete, current, and accurate and is not misleading and that you will not misrepresent your identity. Providing false and/or misleading information or documents is a serious offence under the Commercial Passenger Vehicle Industry Act 2017 and can result in you being fined.

You agree that CPVV may rely on that information unless and until it receives notice from you of any change or update to the information provided by you. Any such varied information will be covered by this warranty.

The failure to provide information as required by the CPVV User Portal may result in a transaction not being processed.

Payments

You agree to pay the fees associated with the transactions that you perform using the CPVV User Portal. To the extent permitted by law, CPVV accepts no responsibility for the delivery of services by any independent third-party service providers and is not responsible for errors made by you when authorising any deduction against your credit or debit card.

If any payment instruction you make on the CPVV User Portal is not successful for any reason, CPVV may not record or may reverse the relevant transaction. This may mean, for example, that the grant of your driver accreditation, commercial passenger vehicle registration or other transaction will not take effect. CPVV will not be liable to you or any other person for any claim, loss, liability damages or expense suffered or incurred as a result of any such unsuccessful transaction.

Any credit or debit card related data (including your credit or debit card details) will not be stored or maintained within the CPVV User Portal.

Provision of CPVV User Portal

You acknowledge and agree that CPVV may:

  • limit your ability to use the CPVV User Portal;
  • monitor your access to the CPVV User Portal;
  • terminate your access to the CPVV User Portal for any reason; and
  • make changes to the CPVV User Portal or discontinue the use of the CPVV User Portal, at any time and without notice to you.

Indemnity

You indemnify CPVV in relation to all loss and damage which is suffered by CPVV or any person arising from any breach by you of these terms and conditions and/or any wilful, negligent, or unlawful act or omission by you in relation to or in the course of using the CPVV User Portal.

Warranties

Except as required by law, CPVV gives no implied or express warranties or guarantees, and makes no representations in relation to the use of the CPVV User Portal. Specifically, CPVV does not warrant or represent:

  • your system will meet the minimum requirements to enable your use of the CPVV User Portal;
  • information provided on the CPVV User Portal is accurate, complete or suitable for any purpose;
  • the CPVV User Portal and its services are free from any computer viruses or defects; or
  • your access to the CPVV User Portal or any services will be continuous or uninterrupted.

Liability of CPVV

To the extent permitted by law, CPVV will not be liable for any loss, damage, cost, or expense of any kind resulting from:

  • your use or inability to use the CPVV User Portal;
  • activities resulting from the loss or misuse of your username or password;
  • inaccuracy or incompleteness of any information displayed on the CPVV User Portal;
  • defects in, or problems with, any computer system or communication link (including delays in electronic communication) arising out of your use of the CPVV User Portal; or
  • any other matter relating to the CPVV User Portal.

Copyright

The CPVV User Portal and its contents are subject to copyright owned by CPVV and the State of Victoria (or its licensors).

You may download, print, or make copies of the content contained on the CPVV User Portal for the purposes of your own private use or internal business operations only. Except as permitted under the Copyright Act 1968 (Cth), you may not reproduce, adapt, modify, copy, transmit, communicate to the public or otherwise use any part of the CPVV User Portal without the prior written consent of CPVV.

Privacy

Personal information CPVV collects from you through the CPVV User Portal will be used and may be disclosed for the purposes of the transaction you are conducting. It may also be used or disclosed as authorised or required by the Privacy and Data Protection Act 2014, the Health Records Act 2001, the Commercial Passenger Vehicle Industry Act 2017, the Transport (Compliance and Miscellaneous) Act 1983 and the Road Safety Act 1986.

CPVV may also disclose your personal information to related government agencies such as Victoria Police, VicRoads, the Australian Criminal and Intelligence Commission and CPVV’s medical panel for the purposes of the functions of CPVV, these government agencies, other bodies or persons. CPVV may also disclose your personal information whenever required to do so by law, for example in order to comply with an order of a Court or Tribunal.

Electronic communications 

By accessing and using the CPVV User Portal you:

  • consent to giving and receiving information and notifications by electronic means pursuant to the Electronic Transactions Act 2000.
  • acknowledge that the CPVV will accept any applicable application made by you under the Commercial Passenger Vehicle Industry Act 2017 and related regulations, and/or the Road Safety Act 1986, as containing your signature for the purposes of the Electronic Transactions Act 2000.”

Changes to terms and conditions

CPVV may update or vary these terms and conditions from to time to time by posting the updated version on CPVV’s website. Subsequent or continuing access or use of the CPVV User Portal will constitute acceptance of any changes to these terms and conditions.

Jurisdiction

Use of the CPVV User Portal and these Terms and Conditions are governed by the laws of the State of Victoria.
